The guy that signed my daughters birth certificate isn’t the real father. Can I get his named removed?

When i gave birth, the guy i was with decides to sign the birth certificate. He is not the father of my daughter and he is now trying to get custody of my daughter. What can I do about his name being on the birth certificate? Can I get it changed or is his name permanant? Also with his name being on the certificate, and him not being the real father, what kind of rights does he have? Any sort of help on this matter would be great.

You need to talk to the Attorney General’s office in your state. They will probably want to do DNA testing to rule him out and rule the real father in. If you have custody of the child and his name is on the certificate then he would be obligated to pay child support, he, however has the right to ask for visitation privileges till you prove he is not the father. Hopefully this won’t take a lawyer and you won’t have to adopt your own child to change the certificate.
